Terms & Conditions

1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of services, facilities, and digital platforms operated by NOVA (SG) LABS PTE. LTD. (“NOVA”, “we”, “us”, “our”).

By booking a session, purchasing a membership, or using our services, you agree to be bound by these Terms.

2. Eligibility

• Services are available only to individuals aged 18 years or older
• Access may be restricted to members of Royal Bangkok Sports Club (“RBSC”)
• You must provide accurate and complete information when registering

3. Services

NOVA provides wellness and recovery services, including:

• Ice bath therapy
• Sauna sessions
• Structured recovery programs
• Wellness tracking and performance analytics

All services are subject to availability and may be modified or withdrawn at any time.

4. Health & Safety Requirements

Participation in NOVA services requires:

• Completion of a health declaration and liability waiver prior to first use
• Compliance with all safety instructions provided by staff
• Agreement to undergo basic safety checks where required (e.g. heart rate, blood pressure)

NOVA staff are trained in supervision and emergency response procedures.

NOVA reserves the right to refuse or terminate service at any time if a user’s condition or behaviour presents a safety risk.

5. Assumption of Risk

You acknowledge that participation in ice bath, sauna, and recovery therapies involves inherent risks, including but not limited to:

• Dizziness or fainting
• Dehydration
• Cardiovascular stress
• Physical injury or adverse health effects

You voluntarily assume all risks associated with participation.

6. Supervision and Compliance

• All sessions are supervised by trained staff
• Users must follow all instructions at all times
• Maximum usage durations for ice baths and sauna sessions are strictly enforced

Failure to comply may result in immediate termination of the session without refund.

7. Bookings and Attendance

• Sessions must be booked in advance where applicable
• Users must arrive on time
• Late arrivals may result in reduced session time or forfeiture

NOVA tracks check-ins, session attendance, and facility usage for operational purposes.

8. Memberships

• Memberships are subject to specific plan terms
• Founding memberships are non-refundable and non-transferable
• Memberships do not auto-renew unless explicitly stated
• Unused sessions may expire based on membership conditions

9. Payments

Payments are processed via Stripe.

• NOVA does not store credit card details
• All payments must be completed prior to service use
• Pricing is in Thai Baht unless otherwise stated

Payment records and receipts may be shared with The Royal Bangkok Sports Club for operational and accounting purposes.

10. Cancellations, Rescheduling, and Refunds

• Bookings are non-refundable, including no-shows
• Rescheduling may be permitted within a specified timeframe at NOVA’s discretion
• Membership fees are non-refundable unless required by law

11. User Conduct

You agree to:

• Follow all safety rules and instructions
• Use facilities responsibly
• Respect staff and other users

NOVA may suspend or terminate access without refund if you:

• Violate safety instructions
• Act in a dangerous or disruptive manner
• Misuse the platform or services

12. Right to Refuse Service

NOVA reserves the right to refuse or terminate service at any time for:

• Safety concerns
• Medical concerns
• Behavioural issues
• Operational reasons

13. Research and Data Use

NOVA may conduct research and analytics to improve services.

• Participation in research programs is voluntary
• Only users who explicitly opt in will have their data used for research or AI development
• Where possible, data will be anonymised or aggregated

14. Relationship with RBSC

NOVA operates as an independent service provider within The Royal Bangkok Sports Club.

NOVA is solely responsible for its services, operations, and liabilities.

15. Limitation of Liability

To the maximum extent permitted by law:

• NOVA is not liable for indirect, incidental, or consequential damages
• NOVA’s total liability shall not exceed the amount paid for the relevant service

Nothing in these Terms excludes liability where it cannot be excluded under Thai law.

16. Privacy

Your use of NOVA services is also governed by our Privacy Policy.

Personal data is handled in accordance with the Personal Data Protection Act (Thailand).

17. Third-Party Services

NOVA uses third-party providers (e.g. payments, analytics, hosting).

NOVA is not responsible for the performance or policies of these services.

18. Changes to Terms

NOVA may update these Terms at any time.

Continued use of services constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by the laws of Thailand.

Any disputes shall be subject to the jurisdiction of Thai courts.
